day, the eighteenth of July, 1692, in the forenoon, in the city of Bayonne,
before me the undersigned Notary Royal,
in the presence of the witnesses named below,
Sieurs Charles
Maynadier and Francois Tournal,
Navy surgeons
on the King's ships La Légère and
L'Aigle, at present residing in this city, appeared in person and confirmed
their identity.
Voluntarily and of their own
free will, they have promised and agreed, jointly and severally, each
for the
other and each one singly for both, and renouncing any division, discussion, or
order of claim,
in accordance with the
practices of the said city, by which they have been given a hearing by me, a
Notary,
to relieve of
all liability, and to guarantee to
Sieur
Pierre de
Lacoste, citizen and Master Surgeon of the said
town,
here present, and to
accept entirely whatever may be asked of him, in principal,
interest, and costs,
for posting a certain bail
bond,
which the said Sieur de Lacoste entered before the Sieur
Lieutenant of the Criminal Court of Labour,
on behalf of the said
Sieur
Charles Maynadier, in order to obtain his release from
the prison where he was detained,
as the result of a charge
brought against him, in which he was accused of the crime of abduction, on
behalf of
Domeins de
la Hitte,
residing at
St Jean de Luz

He [Sieur Lacoste]
may,
in
whatever way suits him, during the absence of
the said Sieurs Maynadier and
Tournal in the King's Naval service,
pay charges, or pay damages and interest thereon.
The said
Sieurs,
jointly and severally, have promised to reimburse the said Sieur Lacoste,
and in order to do so, they have, at the present moment and in fact, counted and
remitted by hand the sum of 61 livres, 5 sols
and 5 louis d'ors,
as well as a promissory note
for
the sum of
183 livres and 15 sols, payable to the said
Sieur Lacoste by Sieur Dominique de Behic, citizen and
merchant of this city, making a
sum total of 245
livres, which will serve the said Sieur Lacoste
as security for his compensation and payment of costs or for any
part thereof, provided that he submits an account to them.
In addition, the said Sieur Charles Maynadier has made and constituted the said Sieur
Lacoste his proxy, with power of attorney, expressly and irrevocably,
for the continuation of the said lawsuit, with power to
lay charges, to sign all documents both judicial and extrajudicial, enter an appeal if necessary, to elect a
domicile and to substitute a proxy or attorney only for making the plea for the defendant, to arbitrate, compromise and accommodate the case,
in whatever way the said proxy
[Lacoste] finds best for the benefit of the said grantor
[Maynadier].
And to execute the above, the said parties
have each pledged as collateral all their assets, and submitted themselves to
the full rigours of justice.

and here signed with the said parties and by me.
